§ 1 DEFINITIONS 

Working days - days from Monday to Friday, excluding public holidays. 

Account - a free Store function regulated by separate regulations (service provided electronically), thanks to which the Buyer can set up his individual Account in the Store. 

Consumer Consumer, as defined by the Civil Code. 

Buyer - every entity buying in the Store. 

Regulations - these regulations. 

Store - natur.toys online store run by the Seller at https://www.natur.toys. 

Seller - PAWEŁ MIROSŁAW BORODZIUK, an entrepreneur running a business under the name PAWEŁ BORODZIUK KRASNOLUDEK - ZIARENKO, entered into the Central Register and Information on Economic Activity conducted by the minister responsible for economy and keeping the Central Register and Information on Economic Activity, NIP 6771978310, REGON 852485070, 17 Kozienicka Street, 30-397 Kraków, Poland.

§ 3 TECHNICAL REQUIREMENTS 

  1. For the proper functioning of the Store you need: 

  • A device with Internet access 

  • An internet browser that supports JavaScript and cookies. 

  1. For placing an order in the Store, in addition to the requirements set out in paragraph 1, an active e-mail account is required. 

 

§ 4 PURCHASES IN THE STORE 

  1. Prices of goods visible in the Store are total prices for goods, including VAT. 

  1. The Seller points out that the total price of the order consists of the price indicated in the Store: the price for the goods ordered and, if applicable, the costs of delivery of the goods. 

  1. The product selected for purchase should be added to the basket in the store. 

  1. Next, the Buyer selects from the options available in the Store: the method of delivery of the goods and the method of payment for the order, as well as provides the data necessary to complete the order. 

  1. The order is placed at the moment of confirming its content and acceptance of the Regulations by the Buyer. 

  1. Placing an order is the same as concluding a sales contract between the Buyer and the Seller. 

  1. The Seller shall provide the Consumer with confirmation of the conclusion of the sales contract on a durable medium at the latest at the time of delivery of the goods. 

  1. The Buyer may register in the Store, i.e. set up an Account in it or make purchases without registration by providing his data with every individual order. 

 

§ 5 PAYMENTS 

  1. For the order placed you can pay, depending on the choice of the Buyer: 

  1. By ordinary transfer to the Seller's bank account. 

  1. Through the payment platform: 

  • PayPal payments 

  1. If you choose to pay via the PayPal payment platform, the PayPal payment service provider is PayPal INc 

  1. If the Buyer selects payment in advance, the order must be paid within 3 Business Days of placing the order. 

  1. The Seller informs that in the case of some payment methods, due to their specificity, the payment of the order by this method is possible only directly after placing the order. 

  1. The Buyer, when making purchases in the Store, accepts the use of electronic invoices by the Seller. The Buyer has the right to withdraw his acceptance. 

 

§ 6 ORDER COMPLETION 

  1. The seller is obliged to deliver the goods without defects. 

  1. The order completion time is indicated in the Store. 

  1. If the Buyer chose payment in advance for the order, the Seller will proceed with the order after paying for it. 

  1. In a situation where, within one order, the Buyer purchased goods with different delivery dates, the order will be processed within the deadline for the goods with the longest delivery time. 

  1. The goods can be delivered on the territory of Europe and beyond. 

  1. Goods purchased in the Store are delivered depending on which delivery method has been chosen by the Buyer: 

  1. Via courier 

 

§ 7 RIGHT OF WITHDRAWAL FROM THE AGREEMENT 

  1. The consumer has the right to withdraw from the contract concluded with the Seller via the Store, except in situations described in § 8 of the Regulations, within 14 days without giving any reason. 

  1. The deadline to withdraw from the contract expires after 14 days counting from the day: 

  1. In which the Consumer came into possession of the goods or in which a third party, other than the carrier, indicated by the Consumer became the owner of the goods. 

  1. In which the Consumer came into possession of the last item or in which a third party, other than the carrier, indicated by the Consumer, came into possession of the last of the items, in the case of a contract obliging to transfer the ownership of many items that are delivered separately. 

  1. Conclusion of the contract - in the case of a contract for the supply of digital content. 

  1. In order for the Consumer to exercise his right to withdraw from the contract, he or she must inform the Seller, using the data provided in § 2 of the Regulations, of his decision to withdraw from the contract by means of an explicit statement (for example, a letter sent by mail or information sent by email). 

  1. The Consumer may use the model withdrawal form at the end of the Regulations, but it is not obligatory. 

  1. To meet the deadline for withdrawing from the contract, it is sufficient for the Consumer to send information related to his or her right to withdraw from the contract before the deadline for withdrawal from the contract. 

 

EFFECTS OF WITHDRAWAL FROM THE AGREEMENT 

  1. In the event of withdrawal from the contract, the Seller shall return to the Consumer all payments received from him / her, including delivery costs (except for additional costs resulting from the method chosen by the Consumer other than the cheapest method of delivery offered by the Seller), immediately, and in any case no later than 14 days from the date on which the Seller was informed about the Consumer's decision on exercising the right to withdraw from the contract. 

  1. The reimbursement shall be made by the Seller using the same payment methods as were used by the Consumer in the original transaction, unless the Consumer agrees to a different solution, in each case the Consumer will not incur any fees in connection with this reimbursement. 

  1. The Seller may withhold the reimbursement of the payment until the goods are returned or until the proof of returning the goods is provided to the Seller, depending on which event occurs first. 

  1. The Seller requests you to return the goods to the following address: 22 Dekarzy Street, 30-414 Kraków, Poland, immediately, and in any case not later than 14 days from the date on which the Consumer informed the Seller about the withdrawal from the sales contract. The deadline is met if the Consumer sends back the goods before the expiry of the 14-day period. 

  1. The Consumer bears the direct costs of returning the goods. 

  1. The Consumer is liable only for the decrease in the value of the goods resulting from using it in a different way than was necessary to establish the nature, characteristics and functioning of the goods. 

  1. If, due to their nature, the goods cannot be sent back in ordinary mode by post, the Consumer will also have to bear the direct cost of returning the goods. The Consumer will be informed about the estimated amount of these costs by the Seller in the description of the goods in the Store or when placing the order. 

 

§ 8 EXCEPTIONS FROM THE RIGHT TO WITHDRAW FROM THE AGREEMENT 

  1. The right to withdraw from a distance contract is not entitled to the Consumer in relation to the contract: 

  1. In which the object of the service is a non-prefabricated item, manufactured according to the Consumer's specification or serving to satisfy his individual needs. 

  1. In which the object of the service is an item subject to rapid deterioration or having a short shelf-life. 

  1. In which the object of the service is an item delivered in a sealed package, which after opening of the packaging cannot be returned due to health protection or hygiene reasons, if the packaging was opened after delivery. 

  1. In which the object of the service are items that after delivery, due to their nature, are inseparably connected with other items. 

  1. In which the object of the service are sound or visual recordings or computer software delivered in a sealed package, if the packaging has been opened after delivery. 

  1. For the delivery of newspapers, periodicals or magazines, with the exception of a subscription agreement. 

  1. In which the price or remuneration depends on fluctuations in the financial market, over which the entrepreneur has no control, and which may occur before the deadline to withdraw from the contract. 

  1. For the delivery of digital content that is not recorded on a tangible medium, if the performance began with the Consumer's explicit consent before the deadline for withdrawal and after informing the entrepreneur about the loss of the right to withdraw from the contract. 

  1. The right to withdraw from a distance contract is not available to an entity other than the Consumer. 

 

§ 9 COMPLAINTS 

  1. In the case of a defect in the goods, the Buyer has the opportunity to file a complaint in relation to the defective goods on the basis of the warranty or guarantee provided in the Civil Code, if the guarantee has been granted. 

  1. By using the warranty, the Buyer may, on the terms and in the deadlines specified in the Civil Code: 

  1. Submit a price reduction request 

  1. With a material defect - submit a statement of withdrawal from the contract 

  1. Demand for the replacement of items with similar items free of defects 

  1. Request removal of the defect 

  1. The Seller asks to submit a complaint based on the warranty to the postal address or electronic address indicated in § 2 of the Regulations. 

  1. If it turns out that in order to consider the complaint, it is necessary to deliver the goods (which are the object of the complaint) to the Seller, the Buyer is obliged to deliver the goods, in the case of the Consumer at the Seller's cost, to the address of 22 Dekarzy Street, 30-414 Kraków, Poland. 

  1. If the product has been granted an additional warranty, information about it, as well as its terms, is available in the product description in the Store. 

  1. Complaints regarding the operation of the Store should be sent to the e-mail address indicated in § 2 of the Regulations. 

  1. Consideration of the complaint by the Seller will take place within 14 days. 

 

EXTRAJUDICIAL METHODS OF EXAMINING COMPLAINTS AND INVESTIGATING CLAIMS 

  1. If the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, among others: 

  1. Mediation conducted by the competent regional inspectorate of the Trade Inspection, to which you should apply for mediation. As a rule, the proceedings are free. The list of Inspectorates can be found here: https://www.uokik.gov.pl/wazne_adresy.php#faq595 

  1. Assistance of the relevant and permanent arbitral consumer court operating at the Provincial Inspectorate of Trade Inspection, to which an application for review of the case before the arbitral tribunal should be submitted.   1. Free of charge help from the municipal or poviat Consumer Ombudsman.

§ 10 PERSONAL DATA 

  1. The administrator of personal data provided by the Buyer when using the Store is the Seller. 

  1. The Buyer's personal data are processed on the basis of a contract and for its implementation, in accordance with the principles set out in the General Regulation of the European Parliament and of the Council (EU) on data protection (GDPR). Detailed information regarding data processing by the Seller is included in the privacy policy posted in the Store. 

§ 11 DISCLAIMERS 

  1. It is prohibited to provide the Buyer with unlawful content. 

  1. Each order placed in the Store is a separate sales contract and requires separate acceptance of the Regulations. The contract is concluded on time and in order to fulfill the order. 

  1. Contracts concluded on the basis of these Regulations shall be concluded in English. 

  1. In the event of a possible dispute with the Buyer who is not a Consumer, the competent court will be the court relevant with regards to the seat of the Seller. 

  1. None of the provisions of these Regulations exclude or limit the rights of the Consumer resulting from the provisions of law. 

  1. Provisions regarding goods shall apply accordingly to digital content, unless the Regulations specify these matters separately.

§ 3 TECHNICAL REQUIREMENTS 

  1. For proper functioning and setting up an Account, you need: 

  1. An active e-mail account 

  1. A device with Internet access 

  1. A web browser that supports JavaScript and cookies 

 

§ 4 ACCOUNT 

  1. Establishment of the Account is entirely voluntary and depends on the will of the Buyer. 

  1. The account gives the Buyer additional possibilities, such as: viewing the order history submitted by the Buyer in the Store, checking the order status or editing the Buyer's data. 

  1. In order to create an Account, complete the relevant form in the Store. 

  1. At the time of creating the Account, an agreement is made for an indefinite period of time between the Buyer and the Seller with regard to the maintenance of the Account in compliance with the terms specified in the Regulations. 

  1. The Buyer may cancel the Account without incurring any costs at any time. 

  1. In order to cancel the Account, please send your resignation to the Seller at the following e-mail address: admin@natur.toys, which will result in immediate deletion of the Account and termination of the Account Maintenance Agreement. 

 

§ 5 COMPLAINTS 

  1. Complaints regarding the functioning of the Account should be sent to the e-mail address admin@natur.toys. 

  1. The complaint sent by the Seller will be examined within 14 days. 

 

EXTRAJUDICIARY METHODS OF EXAMINING COMPLAINTS AND INVESTIGATING CLAIMS 

  1. If the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, among others:

§ 6 PERSONAL DATA 

  1. The administrator of personal data provided by the Buyer when using the Store is the Seller. 

  1. The Buyer's personal data are processed on the basis of a contract and for its implementation, in accordance with the principles set out in the General Regulation of the European Parliament and of the Council (EU) on data protection (GDPR). Detailed information regarding data processing by the Seller is included in the privacy policy posted in the Store. 

§ 7 DISCLAIMERS 

  1. It is prohibited to provide the Buyer with unlawful content. 

  1. The Agreement regarding the keeping of the Account is concluded in Polish. 

  1. In the event of important reasons referred to in paragraph 4, the Seller has the right to change these Account Regulations. 

  1. Important reasons referred to in paragraph 3 are: 

  1. the need to adapt the Store to legal provisions applicable to the activities of the Store 

  1. improving the security of the service provided 

  1. changing the functionality of the Account that requires modification of the Account regulations. 

  1. The Buyer will be informed about the planned change in the Account Regulations at least 7 days before the change is implemented via an e-mail sent to the address assigned to the Account. 

  1. If the Buyer does not accept the planned change, he or she should inform the Seller about it by sending an appropriate message to the Seller's e-mail address admin@natur.toys, which will result in the termination of the Account maintenance contract as soon as the planned change enters into force, or earlier if the Buyer makes such a request. 

  1. In a situation where the Buyer does not object to the planned change until its entry into force, it is assumed that he or she accepts it, which does not constitute any obstacle to the termination of the contract in the future. 

  1. In the event of a possible dispute with the Buyer who is not a Consumer, the competent court will be the court relevant with regards to the seat of the Seller.  

  1. None of these regulations excludes or limits the rights of the Consumer under the law.
